Indiana Court of Appeals Affirms Summary Judgment for Mother on Negligent Parental Supervision Claim

John Mead and Jan Campbell won summary judgment at the Trial Court, which was affirmed by the Indiana Court of Appeals on September 28, 2022. Plaintiffs argued that Defendant was liable for the alleged "bullying and misconduct" of her daughter when the daughter was a minor and for an altercation that occurred when the Defendant's daughter was 18 years old. The Court found that the tort of negligent parental supervision applied only when the parent's daughter was a minor. The undisputed facts established the altercation occurred when the daughter was not a minor. Before she turned 18, Plaintiffs failed to identify any established tort theory that applied to the daughter's conduct.
